Terms of Service

These Terms of Service ("Terms") govern your access to and use of Ball or Bench, a football accountability platform operated by SVMS Consultancy Limited (Company Number SC514512), a company registered in Scotland, trading as 360TFT ("Company", "we", "us", or "our").

By creating an account or using the service, you agree to these Terms. If you do not agree, you must not use the service.

1. Definitions

• "Service" means the Ball or Bench website and app at ballorbench.com
• "Player" or "User" means any individual who uses the Service
• "Card" means your in-app football card, with its rating, tier, and streak
• "Evidence" means the training proof you submit (text or video)
• "Crew" means a private group of players who can see each other's progress
• "Founding tier" means a one-time lifetime purchase made during launch

2. What Ball or Bench Is

Ball or Bench is an accountability and motivation tool. You log your training, submit evidence, and your card grows when you keep the work up and cools off when you stop. It is designed to build a habit, not to coach you.

Ball or Bench provides motivation and a record of your own training. It is not, and is not a substitute for:

• Professional coaching, qualifications, or certification
• Medical, physiotherapy, or sports science advice
• Safeguarding or child protection guidance for a club or organisation
• First aid or emergency treatment

Train sensibly and within your ability. You are responsible for your own safety, and a parent or coach is responsible for the safety of a child training under their care.

3. Eligibility and Accounts

The first public release accepts accounts for players aged 13 and over:

• 18+: a self-managed account with full access.
• 13-17: an account with a parent or guardian contact. Training video can be shared with a private crew, but not a public feed.
• Under 13: new signup is closed. Earlier cards and uploads remain held until parent account checks are ready and reviewed.

You agree to give accurate information, keep your login secure, and accept responsibility for activity on your account. We may suspend or close accounts that break these Terms or are used fraudulently.

4. Founding Tiers and Payments

4.1 Founding lifetime tiers

Ball or Bench offers a one-time lifetime purchase in US dollars, priced in founding waves:

• Founding 100: $99 (first 100 players)
• Next 200 players: $149
• Next 300 players: $199
• Open price thereafter: $249

A lifetime purchase gives you access to the core Ball or Bench app for as long as we operate the Service. Optional add-ons or a separate community membership may be offered at additional cost and are not part of the lifetime purchase.

4.2 Payment processing

Website payments are processed by Stripe. Purchases in the iOS app are processed by Apple, with RevenueCat used to check and restore access. We do not store your full card details. By paying, you authorise the applicable payment provider to charge your chosen payment method. For a child's account, the payment is made by the parent or guardian.

4.3 Refunds and your cancellation rights

If you are a consumer in the UK or EU, you have a statutory right to cancel a digital purchase within 14 days. Because a lifetime purchase gives immediate access, this right may be affected once you start using the Service, and we will tell you about this at checkout. We also honour refunds for duplicate or erroneous charges. To ask about a refund, email admin@360tft.com with your account email.

5. Evidence and Your Content

You keep ownership of the evidence and content you submit. By submitting it, you grant us a non-exclusive, worldwide, royalty-free licence to store and display it within the Service for the purpose of running your account, card, and crew.

You agree that any photo or video you upload:

• is of your own training, and you have the right to share it;
• does not show another person without their permission (or, for a child, their parent's permission);
• does not contain anything unlawful, harmful, or inappropriate.

For 13-17 accounts, video stays inside a private crew and is never shown on a public feed. Earlier under-13 uploads remain closed.

6. Acceptable Use

You agree not to use the Service to:

• break any law, or infringe anyone's rights;
• bully, harass, abuse, or harm another person;
• upload content that endangers a child's safety or welfare;
• submit false evidence or game the streak, tier, or referral system;
• attempt to access other accounts or our systems without permission;
• use bots or scripts to access the Service, or resell or commercially exploit it without our permission.

We may suspend or close your access immediately for a serious breach, particularly anything affecting a child's safety.

7. Safeguarding and Child Protection

Ball or Bench currently accepts players aged 13 and over. To protect younger players:

• under-18 accounts are private by default and cannot post to any public feed;
• new under-13 signups are closed, and earlier cards and uploads stay held;
• tier-drop notices go privately to an approved parent contact when one is recorded; otherwise they may go to the account email;
• you can report a concern at any time by emailing admin@360tft.com, and we will act promptly and, where needed, cooperate with the relevant authorities.

8. Benching and Streaks

"Benching" is a feature of the game, not a punishment from us. If you stop logging training, your card cools off and your tier can drop, exactly as described in the app. Benching affects your in-app card only. It does not delete your account or remove your access, and you can climb back at any time by training again.

9. Intellectual Property

The Service, including its design, the card system, and underlying technology, is owned by SVMS Consultancy Limited and protected by intellectual property law. You may not copy, modify, distribute, or create derivative works from it without our written permission. This does not affect your ownership of your own evidence and content under section 5.

10. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that it will be uninterrupted or error-free. Our total liability for any claim relating to these Terms or the Service will not exceed the amount you paid us in the 12 months before the claim. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless SVMS Consultancy Limited, its directors, employees, and agents from any claims, damages, losses, or reasonable legal costs arising from your use of the Service, your breach of these Terms, or your infringement of a third party's rights.

12. Changes, Termination, and Governing Law

We may modify, suspend, or discontinue the Service or update these Terms; for material changes we will give reasonable notice. We may suspend or close your access if you breach these Terms or if we are required to by law. Provisions that by their nature should survive (such as intellectual property, limitation of liability, and indemnification) will survive.

These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, nothing here affects your statutory rights or your right to bring proceedings in your country of residence.
